Mediation is especially effective in the event that:

• the dispute is particularly complex in its essence or in the legal sense;
• the subject of the dispute does not constitute the resolution of the conflict completely, but solely expresses its external side or covers individual points;
• the parties for some reason do not want their dispute to be considered by the court (the publicity of the trial, the period of case examination is long, the costs of the trial can derail the victory in the process);
• consequently the parties may have a close personal or business relationship;
• the court decision related to the case is likely to be appealed;
• the outcome of the proceedings is unpredictable or the trial of this case has no prospects for the parties.

Mediation is possible solely when both parties wish to resolve the conflict.

Based on the results of the applied judicial mediation procedure, it is feasible as follows:

• conclusion of a settlement agreement in respect of all or part of the stated claims;
• partial or complete waiver of the claim;
• partial or full recognition of the claim;
• recognition of the facts on which the other party bases its claims or objections;
• agreement on the facts of the case
  
  All the agreements developed during the mediation process can be fixed by a judge, unless it is contrary to the law. At the same time, they will have the same legal force as an ordinary court decision. Therefore, the resumption of the trial on the basis of the same facts is excluded. If the terms of the agreement are not complied with, you will have the opportunity to consider the issue of its non-performance in any way that you may choose, as well as in case of violation of any legally formalized contract. However, it rarely occurs since mediation agreements are considerably stronger than the obligations to which an individual is forced by the court.

You can address a mediator to settle a dispute as follows:

• both before the appeal to the court
• and at any stage of civil proceedings
• inter alia in the course of enforcement proceedings.

The mediation does not limit the right to judicial protection and does not hinder the appeal to the court (at the pre-trial stage) or the return to legal proceedings (if the mediation was conducted upon filing of the claim and did not end with the reconciliation of the parties).

The terms of mediation are determined by the agreement on the conduct of the mediation procedure, and the mediation is to be carried out within a period of no more than 60 days.

The duration of the mediation procedure shall not exceed 180 days.

The mediation procedure is confidential and avoids the disclosure of sensitive or commercial information. It is focused on mutually beneficial and informal settlement of the dispute and contributes to the preservation of normal relations between the parties.

As a result of the mediation procedure, there are no losing sides.
